Question: I am starting my own  new small business.  What forms to I need to start my own business?

Every year, thousands of e entrepreneurs  launch small businesses to sell their products or services. Some businesses fail.  Know about starting a business, and acquire the power you have to form a successful business. The following checklist is a great place to start.

Since you do not have employees and you sell taxable items, here are the forms you need.   You are legally required to obtain a business license form, a sellers permit form, and a dba certificate form. A business license is usually a flat tax assessment and a percentage of your gross income -- as opposed to your income taxes on profit, or taxes on the sales of tangible items. At any rate, it is a required business registration tax that you must register for. A sellers permit on the other hand is a sales tax id issued by a state agency and its purpose is to track dealing in items you can touch. I.e., taxable items. Thus if you buy or sell wholesale, or sell retail, you need to get a state sales tax id also called a sellers permit. A dba stands for Doing Business As, and it is the registration of your trade name if you have one. You are required to register your trade name within 30 days of starting your business. Instead of registering a dba, you can simply form an llc form or corporation form and it will have the same effect, namely register your business name form.

You may need a commercial building location if you are opening a retail store.  You will need a commercial lease form but your landlord usually has one prepared for you.  If you work out of home, you will need just a business license and a home occupation permit form.

6.  File for Licenses and Permits

Obtain a federal employment identification number  IRS Form  (you can get that even if you are a sole proprietorship or single-member limited liability company without employees).

Obtain a seller's permit from your state if you will sell retail goods.

Obtain state licenses, such as environmental permits, if necessary.

Obtain a local tax registration certificate/ business license.

Obtain a State Employer Identification Number if you are an employer.


2.  Decide on a Legal Structure for Your Business


You will need either a DBA form, an LLC articles or organization form or corporate articles form.
Here are the types of ownership structures:
Sole proprietorship -- choose that if you are a sole ownerPartnership -- choose that if you have partners. However, an LLC is better for either an owner or partners because it affords corporate protection and tax benefits.  Same goes for a corporation.LLC C Corporation -- this is for larger corporations but you could get that one as well.S Corporation  -- this is for small business but you could get the C corporation if you wanted.3.  Choose a Name for Your Business & Register It
You will need a business name certificate form for your jurisdiction but note that there is a legal newspaper publication, notarization or even filing of proof of publication with this.


7.  Start Marketing


You cannot be in business without clients.  Find them anywhere you can find them.
